This privacy policy, as part of the consent form, sets out how Newbold Nutrition uses and protects any personal information that you provide to us. Newbold Nutrition is committed to ensuring that your privacy is protected by adhering to the General Data Protection Regulation (GDPR) as it applies in the UK, tailored by the Data Protection Act 2018.
This privacy policy is effective from 01.07.23 and will be regularly reviewed and updated. Any directly or indirectly identifiable information that you share with Newbold Nutrition will only be used in accordance with this privacy policy.
What type of information we have
We currently collect and process the following information:
· Name, DOB, age, sex, marital status, religion, living arrangements and occupation;
· Contact information – home address, email and contact telephone numbers;
· Clinical and health information provided by the client.
· Physiological and biochemical information provided by the client and from health and fitness assessments conducted on their behalf
How we collect your information
· We collect your personal data through email contact forms, the online booking system, and through questionnaires and consent forms provided when a service is booked
· We also receive personal information indirectly (if applicable), from Diagnostic Health Partners and other relevant health care professionals that you consult with, only where your consent is provided in advance
What we do with the information
· We collect your personal data to communicate with you to arrange provision of our services, to provide our independent nutrition services to you, and to contact you in the future about other services we may offer
· We collect your personal data to provide professional clinical record keeping of client information in accordance with the British Dietetic Association Guidance for Records and Record Keeping.
· We will not distribute, sell or lease your personal information to third parties unless we have your explicit permission or are required by law to do so.
· We may use your personal information to send you promotional information about third parties which we think you may find interesting if you tell us that you wish this to happen.
· Sometimes, we may share your personal data with relevant health care professionals, only where consent is provided in advance
· In exceptional circumstances, information about a client may be disclosed without consent if it is in the public interest to do so. This might be in circumstances where disclosing the information is necessary to prevent a serious crime or serious harm to other people
Legal Basis we rely on to process personal data
Under the General Data Protection Regulation (GDPR), the lawful bases we rely on for processing this information are:
· You have explicitly consented to the processing for the specific purposes described in this privacy policy. You are able to remove your consent at any point, please contact Vicky Newbold at vicky@newboldnutrition.com
· The processing is necessary in order for us to comply with our obligations under a contract between you and us
· The processing is necessary in pursuit of our “legitimate interests”. A legitimate interest in this context means a valid interest we have or a third party has in processing your personal data which is not overridden by your interests in data privacy and security; or
· The processing is necessary for compliance with a legal obligation to which we are subject
How we store your information
· Newbold Nutrition is committed to ensuring that your information is secure. To prevent unauthorized access or disclosure, we have put in place standard operating procedures to safeguard and secure the information we collect and to protect it against unlawful access and accidental loss or damage.
· All data is stored on password-protected hardware or password-protected cloud-based storage
· Where online software is used for the delivery and management of our services, security measures in place include data encryption, regular back-ups, firewall-protected servers, secure server storage locations
· Records made by Newbold Nutrition relating to the care of a client will be stored for eight years (in line with British Dietetic Association Guidance for Records and Record Keeping).
Your data protection rights
Under data protection law, you have rights including:
· Your right of access - you may request details of personal information which we hold about you under the General Data Protection Regulation (GDPR). If you would like a copy of the information held on our files, please contact Vicky Newbold at vickynewbold@hotmail.com
· Your right to rectification - If you believe that any information we are holding on you is incorrect or incomplete, please contact us as soon as possible. We will promptly correct any information found to be incorrect or incomplete.
· Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances.
· Your right to restriction of processing - You have the right to ask us to restrict the processing of your information in certain circumstances.
· Your right to object to processing - You have the right to withdraw your consent related to the processing of your personal data by contacting us and requesting your personal data to be destroyed.
· Your right to data portability - You have the right to ask that we transfer the information you gave us to another organisation, or to you, in certain circumstances.
· You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
